China's First Negative List for Cross-border Trade in Services Released
China's Ministry of Commerce released the "Hainan Free Trade Port Cross-border Trade in Services Special Administrative Measures (Negative List) (2021 Edition)” (Hereinafter referred to as “Negative List of Cross-border Trade in Services in Hainan”), which clearly lists 70 special administrative measures in 11 categories for foreign service providers, where the areas outside the list are treated equally and equally for domestic and foreign service providers in cross-border trade in services within the Hainan Free Trade Port.
The Negative List of Cross-border Trade in Services in Hainan is different from the “Negative List of Market Access and the Negative List of Foreign Investment Access” in terms of positioning and function. The negative market access list applies to domestic and foreign market players, including domestic enterprises, foreign-invested enterprises and other types of market players market access management of the unified requirements, only for the special management measures of foreign market players, not included in the negative market access list. The Negative List of Foreign Investment Access and the Negative List of Hainan Cross-border Service Trade only list the special management measures for foreign market entities or individuals.
